Anspruchseinbürgerung vs. Ermessenseinbürgerung: The Difference Explained
There are two paths to German citizenship: the entitlement-based naturalization under §10 StAG (Anspruchseinbürgerung) and the discretionary naturalization under §8 StAG (Ermessenseinbürgerung). In this article you'll learn what the difference is; and which path fits you.
Two paths to naturalization
The German Nationality Act (StAG) provides two main paths to citizenship. The key difference: with Anspruchseinbürgerung, you have a legal right to citizenship if you meet all requirements. With Ermessenseinbürgerung, the authority decides at its own discretion.
Anspruchseinbürgerung under §10 StAG
The entitlement-based naturalization is the regular path. The law explicitly says: "ist auf Antrag einzubürgern" (shall be naturalized upon application); meaning the authority must naturalize you if you fulfil all requirements. You have a legal claim.
The main requirements under §10 StAG are:
- 5 years of lawful residence in Germany
- Niederlassungserlaubnis or equivalent residence permit
- German language at B1 level
- Passed Einbürgerungstest
- Livelihood secured without social benefits
- No serious criminal record
- Bekenntnis to the free democratic basic order; including the commitment to the special protection of Jewish life
Important: If you meet all 7 requirements, you have a legal right to naturalization. The authority cannot refuse for political or other reasons.
Ermessenseinbürgerung under §8 StAG
Discretionary naturalization is the exceptional path. The law says: "kann eingebürgert werden" (may be naturalized); the authority decides at its own discretion. Even if you meet the requirements, there is no automatic right.
The requirements under §8 StAG are:
- Legal capacity under §37 StAG (generally from age 16)
- No grounds for expulsion
- Own dwelling or accommodation
- Livelihood secured for self and family members
There is no fixed minimum residence period in the statute itself. In practice, authorities usually require several years of lawful residence; the exact length depends on the individual case.

When does discretionary naturalization apply?
§8 StAG primarily applies in special cases where there is a public interest in naturalization or a hardship case. Examples:
- Top athletes: professional athletes whose naturalization serves Germany's sporting interest
- Scientists and researchers: persons with special importance for research and teaching
- Artists and cultural figures: persons making a special contribution to cultural life
- Hardship cases: e.g. people who, due to special life circumstances, cannot pursue the entitlement path
- Spouses of Germans: there is also §9 StAG with its own rules
Which path fits you?
For most people, Anspruchseinbürgerung under §10 StAG is the right path. It gives you legal certainty; you can rely on your right if you meet all requirements.
Ermessenseinbürgerung is only an option if:
- you do not (yet) meet the requirements of §10 StAG
- but a special public interest exists
- or a hardship case applies
